BOOKING CONDITIONS
The Hiring Contract is between the Hirer and the owner/s of the cottage/s. Any booking incorporates the conditions set out below.
- The Contract for the hire of the property(s) is made on and subject to these conditions; all contracts are between a Hirer (you) and the Owner of the property(s). Character Cottages of St.Davids, Pembrokeshire (“we” or “us”) is authorised, by the Owner to act as the Owner’s agent in terms of administering the booking process and the collection of payments.
- Character Cottages of St.Davids, Pembrokeshire is responsible for administering your booking but at all times acts as an agent under the direction of the Owner. We take no part in the management or maintenance of the properties, accordingly, Character Cottage of St.Davids, Pembrokeshire can and will accept no responsibility for any problems that may arise with any property and all legal responsibility therefore remains with the Owner.
- All information on our website or any other publication produced by us in whatever form and provided verbally is given in good faith and is materially accurate to the best of our knowledge at the time of going to press. Any subsequent changes to information provided supersede any prior information. Although we take all reasonable steps to ensure that our records, website and publications are up to date, we do not have exclusive control of any property and/or its amenities and facilities and accordingly we cannot give any guarantees as to the accuracy thereof. Any advice, guidance and/or recommendation given by any of our staff is a personal opinion only and will not constitute any warranty, guarantee, term or condition.
- Provisional bookings can be made online via our on-line booking system, by ‘phone or email. Your booking will be confirmed when you receive our confirmation letter or email. By completing the online booking form and agreeing to our terms and conditions you agree to be bound by these conditions; by confirming your booking you confirm your intent to accept and to undertake all responsibilities set out here.
The booking form (which will be provided) must be completed and returned with a minimum deposit of 30% of the rental within seven (7) days, in the case of a purely electronic booking the minimum 30% deposit will be due within seven (7) days of confirmation. - The Balance must be paid two (2) calendar months prior to the first day of your holiday. If the first day of your holiday is within two calendar months from the booking date then the full payment is due. Please note that all bookings are subject to availability and a contract is only formed when we issue a booking confirmation to you, which we are under no obligation to do.
- Payment may be made by personal cheque, bank transfer to our nominated account, debit card, credit card or by such other method agreed by us. An additional 3.4% is payable on all card payments. Card payments are by PayPal email Invoice.
- The property must be used by the hirer for holiday purposes only.
- The period of let runs from 4pm (or earlier by agreement) on the day of arrival, to 10am on the day of departure (departure time is non negotiable).
- As a condition of booking you warrant and undertake:
(a): That all information provided to us, including without limitation all occupant details is true and accurate in all respects;
(b) To leave the property, its contents, facilities and surrounds in the same state of repair and condition upon vacation as they were at the start of the hire period;
(c) To be responsible for the cottage and take all reasonable care of it, on departure to leave the cottage in a clean and tidy condition – failure to do so may result in a cleaning surcharge being levied by the owner;
(d) To report any breakage or damage immediately to the owner or to us and to pay, at reasonable cost, for all repairs and all replacements of items rendered beyond repair required as a result of your occupation of the property.
(e) To act promptly and reasonably in respect of any problems arising at the property and bring these to the attention of us and or the owner as soon as is reasonably practicable.
(f) Not to use the property for any non-residential purpose without the express prior consent of the owner;
(g) To take all reasonable safety and security measures at the property during the hire period, including without limitation, all reasonable precautions to avoid the risk of fire and to keep the property secure when unattended;
(h) To comply with the specific requirements of the property, including but not limited to, the maximum permitted occupancy, any prohibition on pets and any prohibition on smoking as detailed in our publications or website or otherwise notified to you by us or the Owner.
(i) During the hire period not to engage in anti-social behaviour and/or criminal activity and to respect other local residents and the locality.
(j) Not to share the property with anyone who is not a member of the party and not to allow any guests to stay overnight unless by prior arrangement with us or the owner.
(k) To use fuel and utilities sensibly and appropriately. - The Owner and/or his representative retain the right to enter the property at any time.
- Without prejudice to any legal rights and/or remedies we and each owner reserve the right to evict all or any occupants of the property at any time where we deem this reasonably necessary as a result of a breach of any of the provisions of condition 9 without refund, and without prejudice to any other right of the owner.
- We reserve the right to refuse any booking at our sole discretion and for any reason.
- Neither we nor the owner will have any liability whatsoever for any personal injury or losses and/or damage to property. You indemnify us and the owner for any costs, damage or loss which are incurred at or to the property where insurance is rendered void, including but not limited to properties not being kept locked and secure, or by any other actions or inaction on the part of you or a member of your party.
- Linen: Rental of the cottage includes freshly laundered bed linen: sheets, pillowcases and duvet covers (not cot linen). If you book for more than one week then fresh bed linen will be delivered each subsequent changeover day if requested. Towels, tea towels and cot linen are not provided unless otherwise indicated.
- As a condition of your booking you agree and acknowledge that all and any personal data you provide us, whether relating to you or to any other member of your party and whether on the booking form or otherwise, may be shared with the owner.
- We may from time to time use the data provided to inform you of news, offers or other services that we think may be of interest to you, unless you inform us that you do not wish to receive such information. We will not pass your details to any third party.
- In the unlikely event of a problem arising during your hire period, you must let us know as soon as possible in order to give us an adequate opportunity to address the complaint. If a problem arises outside of office hours we ask that you contact us either on our office number 01348 87 22 66 on our mobile number 07811 111 568 and leave a message outlining the nature of the problem and a contact telephone number. If the problem is with the property itself, please contact us or the owner whilst you are still at the property so that this can be addressed whilst you are still at the property. If a complaint regarding the property is not raised until after you have left, we and/or the owner may be unable to verify and/or address the issue, you will not be entitled to any remedy or compensation. If a complaint is raised by you as soon as the problem arises (and in any event during your stay) we will use all reasonable endeavours to rectify the matter but no guarantee is offered that this can be rectified during your stay. If we are unable to rectify the matter of the complaint you acknowledge and agree that we and/or the owner are not obligated to provide a refund or compensation. If you are dissatisfied with any aspect of our service more generally, please let us know as soon as possible and we will do everything possible to rectify this.
- Whilst the owner will do what is reasonably practicable to try to rectify any mechanical or electrical problem once we have been made aware of it in accordance with condition 17, no refunds will be given and nether we nor any property owner will have any liability whatsoever in respect of mechanical or electrical failures.
- Any comments, photographs or video sent to us or any of our owners may be used (free of charge) in any marketing material. Pictures and video will be credited with the name on accompanying correspondence.
- This agreement is made on the basis that the property is to be occupied by you for a holiday as set out in the Housing Act 1988 Schedule 1 paragraph 9 and you acknowledge that the tenancy granted by this agreement is not an assured tenancy and that no statutory periodic tenancy will arise when it ends.
- One Cot and one High Chair will be provided if requested. Should more of one of each be requested at least one week in advance of arrival, providing they are unused in other cottages, they will be made available.
- Up to two pet dogs can be accommodated in each cottage, where permitted as indicated in our publications or on our website, except Trem y Don which allows one dog only. Each additional dog may be accommodated by arrangement at an additional charge of £10 per week
Pet dog house rules;
A; please ensure that your pet has everything that it requires for its holiday. Food and water bowls etc. please do not use crockery or cutlery that is intended for human usage at the cottage.
B; please do not use cottage towels for your pet.
C; your pet must never be allowed in bedrooms or on any furnishings within the property.
D; your pet must accompany you at all times, - it must NEVER be left alone in the property.
E; pet fouling within the property is strictly prohibited, - please ensure your pet is fully house trained before booking your cottage.
F; pet fouling must be immediately cleaned up in the grounds of the property and disposed of in sealed plastic bags. - Electricity, heating and hot water are provided at no extra cost. The multi-fuel stoves are fuelled for one day, (where fitted) Extra fuel may be purchased locally. Internet, where available, is provided subject to fair usage, these conditions and the conditions of the provider.
- Should the property be unavailable on the day stated all monies will be refunded without question unless we are able to provide alternative accommodation of the same standard with which you are satisfied, however we are under no obligation to do so. Should you accept alternative accommodation then no refund will be given and neither we nor the owner shall be liable for further refund or compensation. In no event shall the liability of the owners to the Hirer exceed the rental paid for the property.
- While every effort is made to provide the amenities advertised, no liability will fall on us or the owner should restrictions be applied in the event of floods drought, power cuts, acts of god or any other circumstances outside of the reasonable control of the Owners.
- Should you wish to cancel under any circumstances then the 30% of the total rental is forfeit, (we advise you to take out cancellation insurance with your own broker). Should this occur we will use all reasonable efforts to re-let the property for the hire period and will act reasonably in doing so, if we are successful in re-letting the property for the full period at the original rental price we will return your deposit to you minus a £50 Administration charge, should we fail to re-let the property for the full period or for the original rental price then the balance for the outstanding time period or rental price will become due.
- If the cancellation occurs less than two calendar months before commencement of the holiday, the balance also becomes payable unless we are able to re-let the property for the week(s) in question. If successful the balance will be refunded in full to the hirer minus a £50.00 Administration fee.
- An administration charge of £50.00 will be made for any property or date alteration after the booking has been confirmed.
- Alterations cannot be made within two calendar months of the holiday date.
- Neither we nor any property owner will have liability whatsoever for any curtailment and/or cancellation of your holiday and/or any other detriment which results from any event outside our reasonable control, including but not limited to weather conditions, power cuts, road works and governmental action. We recommend that cancellation insurance be arranged with your insurance broker.
The Statutory Rights of the hirer are not affected by these booking conditions. Information on the statutory rights of consumers are available from Trading Standards Departments or the Citizens Advice Bureaux.
